1. Not legal advice
Indium OS provides compliance software and outsourced customer due diligence (CDD) support. It does not provide legal, financial, taxation, or other professional advice, and nothing on this website or within the Platform should be relied upon as such. No client-solicitor or advisory relationship is created by your use of the Platform.
Information about anti-money-laundering and counter-terrorism-financing requirements is provided for general guidance only, reflects our understanding at the time of writing, and may not apply to your circumstances. You should obtain your own independent legal advice before making compliance decisions.
2. Obligations are imposed by law and administered by AUSTRAC
Anti-money-laundering and counter-terrorism-financing obligations are imposed by the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and are administered and enforced by AUSTRAC. Where your agency is a reporting entity, those obligations attach to your agency directly. Indium OS is not a reporting entity acting on your behalf and does not assume your legal obligations.
Indium OS prepares and evidences compliance workflows. It does not lodge or submit reports to AUSTRAC on your behalf, and the decision to lodge, and responsibility for lodging, remains with your agency.
3. Your responsibility
Your agency remains solely responsible for its enrolment and registration with AUSTRAC, its AML/CTF program, its risk assessments, its ongoing customer due diligence, its record-keeping, and any reporting. You are responsible for the accuracy of information you supply and for exercising your own judgement on compliance matters.
4. Consult your own lawyer
The regulatory environment is complex and evolving. You should consult your own qualified legal adviser regarding your specific obligations, and should not treat the Platform, its templates, or this website as a substitute for that advice.
5. No warranty
The Platform and its content are provided on an "as is" basis. To the maximum extent permitted by law, and subject to rights under the Australian Consumer Law that cannot be excluded, Indium OS makes no warranties that the Platform will be error-free or that its use will ensure compliance with any legal obligation.
